Justiça proíbe que servidor trabalhe de casa para não tomar vacina
Um servidor do Tribunal Regional do Trabalho da 19ª Região (TRT-AL), em Maceió (AL), teve seu pedido para seguir trabalhando remotamente ou voltar às atividades presenciais sem tomar a vacina contra a Covid-19 negado pela Justiça Federal. A decisão foi tomada pelo juiz Sebastião Vasques de Moraes, da 4ª Vara Federal de Alagoas, que negou o pedido em caráter liminar. As informações são do Uol.
Através do processo, o servidor público alegou que tem comorbidade para a Covid-19, mas se recusa a tomar a vacina contra a doença. Diante disso, ele pedia a anulação dos atos adminsitrativos que cobram o cartão de vacinação para entrar e circulação em unidades da Justiça do Trabalho, exigência vigente desde 16 de novembro.
Para o funcionário, a exigência da vacinação não busca um “bem coletivo ou a saúde pública, mas constranger o servidor não vacinado a se vacinar”. Além disso, ele argumento que “a vacina não garante imunidade”, informação desmentida por estudos científicos e especialistas em saúde.
Em sua decisão, o juiz negou todos os pedidos do servidor, e lembrou que mais de 600 mil brasileiros já morreram de Covid-19 e que a vacinação “é uma medida essencial para reduzir o contágio por Covid-19, para minimizar a carga viral e assegurar maior resiliência aos infectados”.
“A saúde da coletividade sobrepõe-se ao direito individual de optar por tomar ou não a vacina contra o novo coronavírus, com a única ressalva de contraindicação médica, bem assim que o pretendido trabalho remoto (home office) não é um direito subjetivo absoluto do servidor”, decidiu o magistrado.
